Employment Contract

Labor laws being of territorial application, Going on expatriation invariably impacts on work relations.

No matter that the employee had seniority within the company or that he might have been recruited specifically for a mission abroad, the fact of being sent abroad by his employer does not breach the original work contract. The original contract, unless specified, is only suspended and modified by an additional clause which adapt it to the new employment conditions. Even if the employee signs a work contract with his employer in the expatriation country, he remains linked to his employer in the home country. The local contract is only secondary and essentially regulates relations between the employee and the local company.

On the reverse side, an employee, no matter his nationality, who would be recruited directly with a local contract would be submitted to the strict application of the host country's labor laws
